These terms outline the rights and responsibilities between Promotional Diaries and you (the "Customer") regarding the purchase of goods and services. Promotional Diaries reserves the right to modify these terms at any time, with any updates taking effect immediately upon posting to the website.
Product Availability and Supply
The availability of products offered on our website can change at any time. Promotional Diaries reserves the right to alter, replace, or discontinue products as necessary to meet demand or manufacturing changes. Slight variations in colour, size, and materials may occur between production runs due to manufacturing processes, and these differences are considered standard.
Order Placement and Confirmation
To ensure clear communication and accurate processing, all purchase orders must be submitted in writing, preferably via email. This written record will confirm the specifics of the Customer's order, including customizations and delivery requirements. Any verbal discussions must be confirmed in writing to avoid potential misunderstandings.
Artwork Submission for Custom Orders
Customers ordering custom-branded diaries are required to submit artwork according to the guidelines provided on our website. These guidelines ensure the submitted artwork meets our quality standards for printing and branding.
Artwork Proofing and Approval
Before production begins, Promotional Diaries will provide a digital proof of the artwork for the Customer’s review and approval. It is the Customer’s responsibility to carefully review this proof for accuracy. Once the artwork is approved, no further changes can be made, and production will proceed according to the final approved design.
Responsibilities of the Customer
By placing an order, the Customer accepts the following conditions:
- Product Variations: Small differences in colour, material, or size may occur between product batches due to the nature of the manufacturing process.
- Colour Matching: While we strive to match PMS colours as closely as possible, minor variations in colours may occur due to differences in printing surfaces and materials.
- Order Quantities: Custom orders may experience a quantity variance of up to ±5%, and the Customer will be billed accordingly for the actual quantity supplied.
- Rush Orders: Expedited production or delivery requests may result in additional fees based on material availability and production capacity at the time of the request.
Shipping, Handling, and Delivery
Freight and handling charges apply to all orders, and these fees will be included in the final invoice. Promotional Diaries takes care to securely package and dispatch products in a timely manner, but cannot be held liable for shipping delays, losses, or damages caused by external courier services or unforeseen circumstances beyond our control. Shipping details, including tracking, will be provided upon dispatch.
Ownership of Goods
Ownership of the goods remains with Promotional Diaries until full payment has been received. Once payment is confirmed, ownership of the items transfers to the Customer.
Inspection of Products and Reporting Defects
Customers must inspect the received goods within seven days of delivery. Any defects or discrepancies must be reported in writing during this period. If defective products are confirmed, the Customer must return them in their original packaging. Promotional Diaries will assess the returned goods to determine whether a replacement or refund is appropriate.
Limitations of Liability
Promotional Diaries limits its liability to the repair, replacement, or refund of defective goods as required by Australian law, particularly under the Competition and Consumer Act 2010 (CCA). We are not responsible for damages or losses caused by delays in transportation or supply chain issues beyond our control.
Exclusion of Implied Warranties
Unless expressly stated, all implied warranties or conditions are excluded to the fullest extent permitted by law. Promotional Diaries will pass on any applicable manufacturer warranties to the Customer where relevant.
Limitation on Damages
Promotional Diaries will not be held responsible for any indirect, incidental, or consequential damages arising from the use of our products. Our liability is limited to the replacement, repair, or refund of defective items in line with Australian consumer protection laws.
Payment Terms
Unless otherwise arranged in writing, full payment is required prior to the commencement of production. We accept payments via direct bank transfer without any additional fees. Credit card payments (Visa, Mastercard, or American Express) will incur a 1.75% merchant fee.
Late Payments and Collection
Payments that are not made by the due date may result in additional fees. Should any unpaid debts persist, they may be referred to a debt collection agency, and the Customer will be liable for any legal or collection costs associated with the recovery of the debt.
Order Modifications and Cancellations
Once production begins, cancellations are not accepted unless agreed upon in writing. The Customer will be responsible for any costs incurred up to the point of cancellation. If order modifications are necessary, they must be requested in writing, and any additional costs will be billed to the Customer based on the stage of production at the time of the request.
Returns and Refunds
If goods are found to be defective, the Customer must notify Promotional Diaries within seven days of receipt. Defective items must be returned in their original packaging. Promotional Diaries will assess the returned goods and decide whether a replacement or refund is appropriate. Custom-branded products are non-refundable unless they are proven to be defective.
Product Imagery and Colour Accuracy
Product images displayed on the Promotional Diaries website are intended as a guide only. The actual product may differ slightly from the images shown, particularly in terms of colour due to differences in screen displays and production factors. Customers are encouraged to request physical samples if colour accuracy is critical.
Intellectual Property
The content, design, and graphical elements of the Promotional Diaries website are protected by intellectual property laws. Customers are prohibited from copying, modifying, or distributing any of the website content without prior consent from Promotional Diaries. By submitting artwork, the Customer confirms they have the legal right to use any designs provided and grants Promotional Diaries the right to use the designs exclusively for the production of the order.
Use of Cookies and Third-Party Advertising
The Promotional Diaries website may use cookies through third-party vendors to serve advertisements based on users’ previous visits to our site. We are not responsible for the content of these advertisements. Users may opt out of tracking through Google Ads Settings or Network Advertising Opt-Out.
By placing an order with Promotional Diaries, the Customer confirms they have read, understood, and agreed to these Terms and Conditions. The Customer further acknowledges their rights under Australian consumer law, including those related to product guarantees, warranties, and refunds.
